1. Information We Collect
We collect information you provide directly: account registration data (name, email, phone), profile information, KYC identity documents, yacht listing details, transaction records, and communications on the Platform. We also collect automatically generated data including usage analytics, IP addresses, device information, and cookies. For KYC purposes, we may collect government-issued identification documents as required by applicable anti-money laundering regulations.
2. How We Use Your Information
Your information is used to: operate and improve the Platform; facilitate yacht transactions and escrow services; perform KYC/AML compliance checks; generate Trust Scores and buyer-yacht matches using AI; send transactional communications; provide customer support; and comply with legal obligations. We use AI-powered analysis of your preferences to recommend yachts that match your criteria.
3. Data Sharing
We share your information with: escrow service providers (Escrow.com) to facilitate transactions; KYC/AML verification partners; yacht brokers (only as necessary to facilitate listings and transactions); service providers who assist in operating the Platform; and law enforcement when required by law. We do not sell your personal information to third parties.
4. Data Room Privacy
Documents uploaded to yacht data rooms are stored securely using encrypted storage. Access is controlled by the listing owner and requires NDA acceptance. We maintain audit logs of all data room access. Watermarked documents contain tracking information tied to the downloading user's account. Data room contents are never shared outside the authorized access list.
5. Data Security
We use industry-standard security measures including: encryption at rest and in transit (TLS 1.3); secure session management with HMAC-SHA256 tokens; database connection pooling with encrypted connections; and role-based access controls. Despite our security measures, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
6. Data Retention
We retain your account data for as long as your account is active. Transaction records are retained for 7 years as required by financial regulations. KYC documents are retained in accordance with AML regulations (typically 5 years after the business relationship ends). You may request deletion of your account data subject to legal retention requirements.
7. Your Rights
Depending on your jurisdiction, you may have the right to: access your personal data; correct inaccurate data; delete your data (subject to legal retention requirements); port your data to another service; opt out of AI-powered profiling; and withdraw consent for data processing. 8. International Data Transfers
Your data may be processed in the United States and European Union. For transfers outside the EU/EEA, we rely on Standard Contractual Clauses approved by the European Commission. By using the Platform, you consent to the transfer of your data to these jurisdictions.
9. Cookies
We use essential cookies for session management and authentication. We use analytics cookies to understand Platform usage. You can control cookie settings through your browser. Disabling essential cookies may affect Platform functionality.
10. Children's Privacy
The Platform is not intended for users under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have collected data from a minor, please contact us immediately.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via email or an in-platform notice. Continued use of the Platform after changes constitutes acceptance of the updated policy.
